Consumers resident in the EU have the right to withdraw from contracts a) if the contract is concluded in the simultaneous physical presence of the trader and the consumer, in a place which is not part of the business premises of the trader; b) if the contract is concluded on the business premises of the trader or through any means of distance communication immediately after the consumer was personally and individually addressed in a place which is not part of the business premises of the trader in the simultaneous physical presence of the trader or his agent and the consumer; or c) if the contract is concluded during an excursion organised by the trader or his agent with the intention or effect that the trader advertises or has advertised to the consumer for the sale of goods or the provision of services and concludes appropriate contracts with the consumer; d) if the contract between a trader and a consumer is concluded without the simultaneous physical presence of the trader and the consumer within the framework of a distribution or service system organised for distance selling, using only means of distance communication up to and including the conclusion of the contract; e) the consumer has not made his contractual declaration on the premises permanently used by the trader for his business purposes or at a stand used by him for this purpose at a trade fair or market, or the trader or a third party cooperating with him has brought the consumer onto the premises used by the trader for his business purposes within the scope of an advertising trip, an excursion or a similar event, or by personal, individual contact on the street, and the contract does not fall under points a - d. The client is not entitled to a right of withdrawal under point e ii) f he initiated contact with the trader or the trader’s agent on his own initiative with the purpose of concluding this contract; ii) if no communication took place between the parties or their agents prior to the conclusion of the contract, or iii) for contracts that are fulfilled by means of immediate execution and compensation by the contracting parties, if they are usually concluded away from their normal business premises, and the agreed price does not exceed EUR 25, or if the company is not operated on permanent premises due to its nature, and the agreed price does not exceed EUR 50 iiii) for contract declarations which the consumer has submitted when the trader was not physically present, unless the consumer has been urged to do so by the trader.

The consumer expressly has no right of withdrawal in the case of contracts for a) services concluded at a distance or away from the business premises if the trader – on the basis of an express request by the consumer and a confirmation by the consumer of his knowledge of the loss of the right of withdrawal upon complete performance of the contract – had commenced performance of the service before the expiry of the withdrawal period and the service was then rendered in full, b) goods and skis which are made according to customer specifications or which are or will be clearly tailored to personal needs. The customer acknowledges that ÜNIQUE Skis designs, produces and sells skis according to the personal needs of the customer and his specifications. The withdrawal must take place within 14 days of acceptance by ÜNIQUE Skis. Receipt at ÜNIQUE Skis is decisive for the observance of the deadline. The withdrawal must be made in writing.

The customer bears the shipping costs incurred by the withdrawal and/or by the return of the goods.

- The delivery of goods is made to the delivery address given by the customer, unless agreed otherwise. The delivery address given in the order processing at ÜNIQUE Skis is decisive for the processing of the transaction.

- If the transport company sends the goods back to the ÜNIQUE Skis because a delivery to the customer was not possible, the customer bears the cost of the failed delivery. This does not apply if the customer effectively exercises his right of withdrawal or if he is not responsible for the circumstances that led to the impossibility of delivery.

- If the customer acts as a trader, the risk of accidental loss and accidental deterioration of the sold goods passes to the customer as soon as ÜNIQUE Skis has delivered the goods to the forwarding agent, the carrier or any other person or institution designated to carry out the shipment. If the customer acts as a consumer, the risk of accidental destruction and accidental deterioration of the sold goods essentially passes over only with the transfer of the goods to the customer or a person authorised to receive the goods. In deviation from the above, the risk of accidental loss and accidental deterioration of the sold goods is also transferred to the customer in the case of consumers as soon as ÜNIQUE Skis has delivered the goods to the forwarding agent, the carrier or the other person or institution determined for the execution of the shipment, if the customer has commissioned the forwarding agent, the carrier or the other person or institution determined for the execution of the shipment with the execution and ÜNIQUE Skis has not previously named this person or institution to the customer.

- If the customer collects the goods himself, ÜNIQUE Skis will inform the customer by email that the goods ordered by the customer are ready for collection. After receiving this email, the customer can collect the goods after agreeing the time and place with ÜNIQUE Skis. In this case, no shipping costs will be charged.
